I was linked to a Reddit post today which brought to my attention that PlayStation may be illegally charging sales tax and has been since September 2017. Now the post is about Steam charging digital taxes recently in Colorado, but it also applies to the  PlayStation Network Store and I personally only have experience purchasing from them, not Steam. In that post, it claims these game companies are not allowed to charge Colorado citizens with sales tax for items that are not tangible. And by law, a digital game electronically delivered to you is not considered tangible. A few years ago, in Colorado, companies weren’t allowed to charge sales tax online. But as far as I knew, the law then changed and I figured that was why companies like Amazon and PlayStation eventually started charging me sales tax.

Although, when I say Amazon started charging me sales tax, it was only for physical goods I purchased and had shipped to me. Anytime I purchase a digital code off of Amazon, for PlayStation Store cash or Nintendo eShop cash, I was not charged any sales tax. Similarly, when I purchased digital games and DLC from the eShop for my Nintendo Switch last year (after these tax laws are supposed to have taken effect), I once again was not charged sales tax for them. I went looking into this and found some kind of letter from the Colorado Department of Revenue, for businesses to use, that states they are not allowed to charge sales tax for goods that are not tangible. I also found another site going into some details about the E-commerce sales tax law. This one doesn’t say anything about digital software not being taxable. But the fact that it only states tangible items should be taxed, makes it seem implied companies cannot charge sales tax for intangible items.

After finding this out I went and contacted PlayStation support and they insisted that it was now the law as of September 2017 and that is why they charge tax. They claim that the money I believe they owe me (all of the digital sales tax they’ve charged me since then) isn’t actually owed to me. I’m no lawyer but it’s really difficult to find a clear cut law description or some current dated explanation of the law online from a reputable government source. It’s an obscure law and the American government has many laws, all of which differ in each state. So I could be wrong, perhaps PlayStation hasn’t charged me anything I didn’t owe. But after the searching I did, I couldn’t find something refuting the idea that PlayStation has illegally charged me tax for digital goods once it supposedly became legal to do so. PlayStation support only linked me to their own page about how and why they tax, not an actual description of my state’s law. Ultimately, I find it really strange that two other companies don’t charge me for digital goods and only PlayStation has been doing this. Do any of you reading this know something about it? While rumors like this are certainly not uncommon (fake images like this have “leaked” before), it’s entirely plausible to think that Nintendo might be gearing up to release a system like this. Given the popularity of the NES and SNES Classic systems, what would be better than to follow them up with an N64 Classic system just in time for the holiday season? Additionally, given Sony’s recent announcement of a PlayStation Classic system, a rival Nintendo system would feel right at home.

The Wall Street Journal has reported that there may be a new version of the Nintendo Switch in development. The report apparently comes from “suppliers and others with direct knowledge of the plan”, and the new model would be set to release in the second half of 2019, possibly in the summer.

According to the report, what new features (both hardware and software) to include are still under debate, depending on how much such new features would affect the price of a new model. One idea seemingly being considered is improving the screen, with the Switch currently using a relatively low-end LCD panel compared other modern devices, but it’s unlikely that a new model would use an OLED display like in the iPhone X series.

The new model of the Switch would be intended to continue the console’s sales momentum, which has apparently slowed since its launch. A Nintendo spokesperson has declined to comment on the rumors, however, so at the moment the reports are still unconfirmed.

The mysterious new Pokémon to be introduced in Pokémon: Let’s Go Pikachu! and Let’s Go, Eevee! appears to have been leaked early. During a recent run of Niantic’s Pokémon Go network traffic, images of the normal and shiny variants of a mysterious creature were outed, as spotted by Twitter user Chrales.

The creature in question appears to have a silver body of the mimicry Pokémon Ditto with a screw for a head with a pupil in its center. It has no name, classification, or typing. Niantic has placed its data in a placeholder slot where Hoenn Pokémon Kecleon should be, and it is numbered #352 rather than a predicted #808 in the National Dex.

There’s no telling if the images are legitimately what fans can expect of the promised new Pokémon in the upcoming Pokémon: Let’s Go Pikachu! and Eevee! games. As such, this is marked as a rumor until Nintendo and The Pokémon Company make an official announcement.

Although today’s planned Nintendo Direct was delayed due to a sudden earthquake in Hokkaido, dataminer OatmealDome may have deduced that the broadcast may air on September 14th Japan time. Through digging into the code of Splatoon 2, a couple of not-so insignificant updates were probably planned to coincide with some Splatoon 2-related announcements.

The stage rotation recently excluded the Starfish Mainstage stage due to remodeling, and it was intended to come back in Ranked Play on September 7th, the previous Japanese and European date for this month’s Direct. Now, the code shows a date of September 14th, the date the current stage presets are due to end.

In addition, the Salmon Run mode was due for some new gear, chiefly a pair of orange flippers. Those were once again originally dated for the 7th and now are set to go live on the 14th.

Through probability, this new potential date for a Nintendo Direct would mean North America would air it on the 13th at 6 PM ET. Without Nintendo’s official confirmation, this is presently rumor. As previously announced, the broadcast was to focus on Nintendo 3DS and Switch news for the near future.

If datamining can be believed, fans of Xenoblade Chronicles 2 have a lot in store in the coming months. Be forewarned, nothing official has been stated by Monolith Soft nor Nintendo about these details. Furthermore, the details below do contain spoilers, so if you haven’t played all the way through Xenoblade Chronicles 2, avert your gaze!

Anyway, data mining has brought up a lot of details to speculate. The most recent of which comes from someone named Moosehunter. While diving into the game, these details were found about upcoming DLC and updates:

• New Challenge Mode
• Harder game difficulty
• The ability to fine-tune your game difficulty
• New quests
• A new pouch item that gives 3000 trust
• A new cylinder type
• New accessories to try and break the game with
• Level VI AUX cores
• 2 new Blades that come with new weapons and a brand-new game mechanic
• An “Awakening” mechanic for enemies similar to Pneuma and Pandoria’s
• The “Unique Monster Subjugation Report” that keeps track of unique monsters you’ve killed
• The ability to play as Jin
• New superbosses including Rosa, and level 130-150 enemies

Before that, though, another datamine described the potential plot for the story DLC expected to release later this year. According to the datamine, the story would be set during the Aegis War. You get to control Addam but do not have the ability to use the Drive-Blade mechanic. Instead, characters are controlled separately with 7 Arts each. Addam cannot upgrade his weapon via core chips. Blade data for Jin, Malos, and Haze exist, suggesting they might be rewards or something separate from the story DLC. Lastly, two bonus Blades are suggested to be Shulk and Fiora from the original Xenoblade Chronicles. Shulk fights with the Monado and says his catchphrase, “I’m really feeling it.”

Again, none of this is confirmed by Monolith Soft and Nintendo, so take it as you will. The challenge mode is expected along with additional Blades, but everything else is up in the air. If the rest is true, what are you most excited for? Let us know in the comments!

2015’s Yo-Kai Watch Busters may yet see a North American release, according to the Korean version’s credits. While the Yo-Kai Watch spin-off has so far been an Asian market-exclusive, a Spanish Twitter fan account shared an image from the Korean version’s end credits, which refer to Nintendo of America under localization along with their Korean branch.

Yo-Kai Watch Busters was released in Japan back in 2015 and was a more open-world brawler featuring Level-5’s popular batch of ghosts. The Yo-Kai Watch series has been on the fritz in North America of late, with the third game not released there to date, despite being set in America. Yo-Kai Watch 2: Psychic Specters was the most recent release back in 2016.

If Yo-Kai Watch Busters were to bust its way overseas, expect an announcement during this June’s E3 or thereabouts. Nintendo has repeatedly stated their claim of support for the 3DS going into 2019, adding fuel to the likelihood of more unreleased Level-5 localizations.

Sources at Eurogamer indicated there will indeed be a Diablo III port for Nintendo Switch this year. Such a Switch port is reportedly months away from announcement.

Speculation started last week with an innocuous tweet from Blizzard, showing a video loop of Diablo’s demonic mascot posing as a night light switching on and off. Despite the non-subtlety of the tweet, Blizzard representatives told Eurogamer, “As of now, we do not have any current plans to announce Diablo for Switch,” calling the tweet “a fun engagement piece”.

While Eurogamer’s sources confirmed Diablo III for Switch, they cannot confirm if the game’s expansions, Reaper of Souls and Rise of the Necromancer, will be included as well.

First launching in 2012 for PC, the everlasting dungeon crawler Diablo III has risen to console ports on PlayStation 3 and 4 and Xbox 360 and One. Blizzard has yet to return a comment to Eurogamer on the Switch port’s validation. Given the credibility of both Blizzard’s tweet tease and Eurogamer’s run or rumors in the past, a Switch port of Diablo III may yet come to being.

The latest issue of CoroCoro Magazine has leaked out new information about Pokémon Ultra Sun and Ultra Moon (via Serebi.net).

The new appearances of Ultra Sun and Ultra Moon‘s cover monsters have been seen since the game’s June reveal, previously believed to be forms of Solgaleo and Lunala. This issue of CoroCoro reveals that they are actually new forms of Necrozoma, a Legendary that is seen in Pokémon Sun & Moon’s post-game.

Appearing when Necrozoma absorbs those two Legendaries, they are named “Necrozma Mane of Twilight” and “Necrozma Wings of Dawn”, and each have their signature moves as well: Sunsteel Strike and Moongeist Beam. This construct will be familiar to players of Pokémon Black 2 and White 2, where Kyurem similarly absorbed the power of Zekrom and Reshiram for its new forms.

Another page of CoroCoro shows the exclusive Z-Move of Lycanroc, Radical Edge Storm. It does a heap of damage and clears the battlefield of terrain effects. Any form of Lycanroc must know Stone Edge in order to access this move.

Only a Rockruff given to USUM players via a distribution beginning November 17th will be able to evolve into its Dusk Form, and only between 17:00 and 17:59 at level 25. It will know the ability Own Tempo.

All this premature Pokémon news will likely be included in today’s Nintendo Direct via a trailer, airing 6 PM EST and 3 PM PT. We’ll update the article as it develops, including the localized Western names of the new forms and new Z-Move.

The latest issue of CoroCoro Magazine is leaking out with further details of the new Dusk Form of Pokémon Lycanroc, following its reveal this past weekend. As translated by Serebii.net, it retains the pure Rock typing of its fellow Day and Night forms from Pokémon Sun and Moon. You won’t be able to evolve a Rockruff at dusk to obtain it, however, as the magazine states the Dusk Form is event-only. A special Rockruff distribution will run from game’s launch day, November 17 through January 10, 2018. Only that creature can evolve into its new form within Ultra Sun and Ultra Moon, and not in earlier titles.

According to CoroCoro, Dusk Form Lycanroc’s eyes turn red when its “fighting spirit” is unleashed. The new Lycanroc follows in the footsteps of other post-launch Pokémon games, such as last year’s Munchlax distribution in Sun and Moon. This event even closely follows the Pokémon Platinum introduction of Rotom’s additional forms, which were exclusive at the time and were introduced in later games thereafter.

A new firmware update for Wii U hints at the end of the Miiverse social service. The new Wii U update 5.5.2 U went live this evening, promising “Improvements to system stability and usability: Further improvements to overall system stability and other minor adjustments have been made to enhance the user experience”. There’s more to the update than meets the eye, as Twitter user Shiny Quagsire noted a new line of hidden text that users may encounter when Miiverse eventually shuts down (with the discovery credited to WulfyStylez).

Miiverse was originally introduced with the Wii U back when it launched in November 2012, and came to 3DS the following year. Nintendo’s intention with the social service was for users to share game tips and illustrations across specialized communities. In the five years since, the service asked such life-affirming questions as “Y Can’t Metroid Crawl?“, wrote a bad romance, and allowed users to admire the water.

Nintendo has not yet announced the end date for Miiverse on Wii U and 3DS, but this hidden text plants the seed for when they do. Miiverse already failed to make the jump to Nintendo Switch this March, further hastening its demise.

Thanks to some data-mining, details about Nintendo’s upcoming online service for the Switch may have leaked early.  The service itself, from a leaked logo, will be named “Nintendo Switch Online Lounge”, minus the obvious typo in this early iteration.

The full sum of information comes courtesy of NeoGAF user Atheerios, who shared source code in the Switch’s OS, which lead back to a web applet which connects to a Nintendo.net website.

On the bottom of this site is the message:

You can invite friends to the room via

the Nintendo Switch Online Lounge app.

The additional strings of code give a stronger sense of how you’ll be interacting with your Switch friends online. From appearances, the app is required for lobbies, friend notifications, and voice chat. Those lobby rooms can also be created via codes for those who don’t have the app.

Nintendo will reportedly introduce a miniature plug-and-play Super NES later this year. According to a report from Eurogamer, development on such a device has already begun. This mini Super NES, likely under the Classic Edition moniker, would once again implement the same set-up as last year’s NES Classic Edition, from the simple set-up to 30 built-in games.

Like the NES Classic, software emulation would likely fall once again to Nintendo’s N.E.R.D. division, who’s emulation was praised on the previous system.

Eurogamer’s sources indicate that the existence of the Super NES Classic is a major reason behind the NES Classic’s sudden demise last week. Nintendo alleged that the NES Classic was never intended to be a long-term product, and yet the device was impossible to find in stores from the word “go”. One can hope the rumored plug-and-play follow-up would avoid repeating those dramatic shortages.

Three unannounced amiibo with ties to the Legend of Zelda line were discovered through retailer Best Buy. Not long after the listings were up, Best Buy pulled them from the site, currently leading to an error page.

Evidence strongly points to these three amiibo being tied to the Zelda 30th anniversary amiibo series. Not only did the Best Buy listings mention these figure’s game compatibility with Zelda, as in The Legend of Zelda: Breath of the Wild,  datamining of the Wii U version of said game unveiled the existence of three currently unannounced figures. These secretive Zelda amiibo are to be based on Twilight Princess, Majora’s Mask‘s Fierce Deity Link, and Skyward Sword.

As with the currently available Zelda amiibo, be they from the 30th anniversary line, the Super Smash Bros. line, or the Wolf Link figure, the unannounced amiibo discovered in the game would carry their own exclusive gear and weapons to unlock. As Best Buy clearly posted the listings in error, it will be a while until Nintendo confirms anything about the future of Zelda-related amiibo.

A new rumor suggests that a new season of Sword Art Online will be coming. This comes from the tweets of some individuals who say they’ve seen a test screening of the the film Sword Art Online: Ordinal Scale. Supposedly “SAO will return” was written into the film’s end credits. One of the individuals who said this runs the anime blog Yaraon. No official announcement about a new season has been released.

Before you all get excited, keep in mind that the following is just a rumor as of right now. On the Fire Emblem Warriors page, Fire Emblem Fates: Revelation is also listed as being a Switch game. While I assume that to be the same final DLC released for Fates and not a different game, since I doubt Intelligent Systems has had the time to craft an all new entry already, it’s fun to dream a little. Of course what I want is for a physical version of Fire Emblem Fates: Revelations, but I wouldn’t scoff at new content previously unavailable on the 3DS version.

Let’s be honest, any excuse to spend more time with Big Sis is well worth the price of admission!

While I am rather excited about any new Fire Emblem games, even Warriors, which I know next to nothing about other than it being another Hyrule Warriors Musou offering, I would much rather play an all new tactical Fire Emblem offering on the new system. Hell, I’d even settle for another on my 3DS. Here’s hoping this rumor turns out to be something meaningful and not just an unfortunate clerical error on Intelligent Systems and Nintendo’s parts.

There’s a new rumor regarding Nintendo’s newest console and its advertising. Coming from GoNintendo, it seems that GameStops will be getting advertising materials for the Switch and maybe putting them up soon. These materials include things such as posters and display boxes. The video also mentioned that Legend of Zelda: Breath of the Wild will be available for pre-order not long from now.

I think that all fans of Final Fantasy, past and present, can agree that we would love to have nearly all the games available on one handy disc. I mean, I can’t speak for everyone, but I am a gamer that revels in nostalgia, and the convenience of multiple games in one package really speaks to me. After all, that’s why I loved the idea of the Mega Man Legacy Collection (if not the execution). So the reason this has been brought up is a new rumor floating around the interwebs about some collection of Final Fantasy games, from I all the way to IX, coming to PS4 and Vita.

While this rumor has not been confirmed as the real deal by Square Enix, it is fun to think about it. After all, what better holiday present could they offer than a bunch of our favorite games all wrapped up with a bow? The speculation is also due to the fact that Final Fantasy is nigh on their 30th anniversary, so anything is possible. After all, Square Enix does like making money by repackaging our nostalgia and making us buy it a second time, so who knows? All I know is that this purported Anniversary Collection would be even more awesome than a spacefaring, boozehound, babe magnet bad-ass Moogle captain (not a real thing or even a rumor, but it should be).
